SYNOPSIS

The Hobbit: An Unexpected Journey is the first in Peter Jackson’s highly anticipated trilogy adapting the enduringly popular masterpiece The Hobbit, by J.R.R. Tolkien.

The adventure follows the journey of title character Bilbo Baggins, who is swept into an epic quest to reclaim the lost Dwarf Kingdom of Erebor from the fearsome Dragon Smaug. ‘Watchmen’ battle leads to ‘Foundation’ going to Sony?

Okay, this one is complicated. Bear with us.

Variety reports that Columbia won an auction late Thursday for screen rights to Foundation, Isaac Asimov’s science fiction trilogy quad series. The film will be developed as a directing vehicle for Roland Emmerich. This is a surprise development, possibly stemming from bad blood between Warner Bros. and Fox over Watchmen.

The property was originally developed by Fox and producer Vince Gerardis, then found its way to New Line (a division of WB) and went with Bob Shaye and Michael Lynne as the first major project announcement after the former heads of New Line got bounced formed Unique Pictures at WB.

Gerardis, whose "Created By" formerly represented the Asimov estate, was attached as producer. And Fox would have had to be compensated for its development costs. That became a problem for WB (can’t imagine why, after the pleasant experiences with Watchmen) and the studio let its option lapse, expecting to quietly make a new deal with a clear chain of rights that would have left Fox and Gerardis cut out. So it went to auction. WB bid for Unique and director Alex Proyas, Fox bid for Gerardis. Emmerich and Sony were last minute bidders– it seems that Emmerich’s partner Michael Wimer at Centropolis Pictures had been tracking the availability of the rights since he was Emmerich’s agent at CAA, and Columbia Pictures president Matt Tolmach grabbed it.

Just another Hollywood ending.

David Goyer Expects a ‘Blade’ Reboot

"I heard rumors that they may want to start from scratch with a new person playing Blade,” David S. Goyer told Shock Til You Drop. “It’s funny because I thought about how I never wanted to do a vampire film ever again because I’m sick of it. But I was reading the Tomb of Dracula Omnibus and I hadn’t read them in a long time and I thought it might be cool to do another vampire movie at some point."

Goyer made his name working on the Blade trilogy of films, starring Wesley Snipes. He has since gone on to write and direct many other genre films and thought he put the vampire hunter behind him. Hus next project is an original horror film, The Unborn, opening next month.

"God, it feels like they remake movies five years after they come out now," Goyer added. "I’m sure New Line at some point would like to do another version of it. Me? Never say never, but I think remakes are more successful the more time there is in between. Honestly, I think they should have waited for the new Hulk. I like the new one. But the longer time you have between remakes [and their originals], the better. For me, ten years is the minimum you really need."
 

‘We3’ Director Named

Horror site Shock til you Drop reports that Kung Fu Panda director John Stevenson has been tapped to direct the live-action adaptation of Vertigo’s We3 miniseries. The comic, written by Grant Morrison and illustrated by Frank Quitely, was initially optioned years ago by New Line Cinema, which has since been subsumed by parent company Warner Bros.

Producer Don Murphy told the site, "Even though the film is going to be live-action, we brought on the lead director of Kung Fu Panda. He’s attached to direct We3. We’re doing it as an R-rating. It’s not going to be cutesy. There’s killer rabbits and stuff. We’re in the process right now of trying to figure out where we’re going to make it.

"It was at New Line, but the new New Line doesn’t want to do these kinds of movies. We have two really good prospects. [Producer] Susan [Montford] was able to get this film going just based on the treatment before the comic so we’ve been on this a while."

The official synopsis for the project:

“We3 tells the unforgettable story of three innocent pets — a dog, a cat and a rabbit who have been converted into deadly cyborgs by a sinister military weapons program. Neil Gaiman Talks ‘Coraline’

Neil Gaiman’s Coraline has been turned into an animated film by Henry Selick and the popular author spoke with Premiere about the film, which opens in February. Much of the material is familiar to connoisseurs of the man’s career but he did fill in some gaps.

He discussed how he had the book sent to the director 18 months prior to publication. “That’s true. I mean, Henry didn’t even get the final draft. But the moment I finished it, I gave it to my agent, the redoubtable Jon Levin at CAA, and I said… ‘Well, I want it with Henry Selick and I quite like it with Tim Burton, ’cause I love The Nightmare Before Christmas, and they were the two people who did that, and I think, if it’s gonna be a film, it should be something like that.’ And I don’t know if it ever made it through the ranks to actually land on Tim Burton’s desk and get read, [but] it was really a moot point, because by the end of the week, Henry had read it, said that he wanted to do it, and had put the mechanisms in place. You know, the contract negotiations had already started.”

Gaiman was very pleased with Selick’s fidelity to the source material but clearly things had to be modified between print and screen. “He wrote a first draft that was incredibly faithful,” Gaiman said. “And I think I actually wound up saying to him, ‘Look, I think it’s a bit too faithful,’ because it didn’t feel like a movie, it felt like you were just reading the book. And I sort of encouraged him to expand it into a film a bit more. And the next one he rather nervously added a character and added events, but now the script read like a movie script. And then it was just a matter of him having another six years to find a studio that would give him the money to make the ultimate stop-motion movie.”

He remained uninvolved in the production but remained curious. “I’d go about my life and then I’d sit up one day and think, You know I haven’t seen anything for three or four months now, and I’d phone Henry and I’d say, ‘Have you got anything for me to see?’ And he’d say, ‘Yeah, I’ll get you off a DVD.’ And I’d get a DVD with another 10 minutes of footage on it! [laughs] What’s actually been fun is, because they’re pretty much shooting it exactly in order, the DVDs have been getting scarier and scarier. They started off [and I thought], ‘Well this is rather sweet and rather friendly,’ and the last one that I got I could actually say, ‘No, this is scary, this is really scary.’

Gaiman also addressed the long-delayed film version of his Death: The High Cost of Living. “Well, I think the latest is that we’re all waiting to see what happens to New Line. Death is a very odd thing because, unlike Coraline or Anansi Boys, which I’m doing for Warners, or The Graveyard Book or any of those kinds of things, I don’t own and control the rights to Death. I’m attached to it, I’ve written a script for it, I’m meant to be directing it… but I don’t control it, and for reasons having to do with corporate relationships between DC Comics and Warner Brothers, it has to be done by a Warner Brothers company, and then you have to find a Warner Brothers studio within Warner Brothers that will be a good fit for that film, and of course New Line was a really good fit for that film, and it remains to be seen right now what New Line is when the dust is settled and whether there is a New Line or not.”
 

Court Rules Tolkien Heirs Cannot Seek Punitive Damages Against New Line

hobbit-1690698Trying to follow the lengthy legal entanglements between parties over beloved properties is never fun or easy.  Just as you forget about a lingering case, it re-enters the headlines.  Such is the case with the court ruling this week that J.R.R. Tolkien’s estate can not seek punitive damages from New Line Cinema over profits earned by the Lord of the Rings trilogy.

According to the AP story, “New Line’s attorneys successfully argued that Tolkien’s heirs had to demonstrate a ‘public wrong’ under New York law – which governs the contracts – to claim punitive damages if they win at trial. Jones ruled that the heirs’ grievance ‘is clearly seeking to vindicate private wrongs’.”

The laws suit continues to move toward its October 2009 trial date as the estate is suing for $150 million in compensatory damages in a breach of contract suit.  Los Angeles Superior Court Judge Ann I. Jones ruled this week that the plaintiffs have established a legal basis for the fraud claim against the studio which is a part of Time Warner.

Among the claims are that millions in profits were funneled into an advertising expense line and offices built in New Zealand for production of the Lord of the Rings trilogy have subsequently been used for other studio projects.

The estate claims they have yet to see money despite the trilogy earning some $6 billion. As a result, they are seeking the court to order the currently planned two film adaptation of The Hobbit to be halted.
 

Fox Sues Warner Bros. Over ‘Watchmen’

Yesterday we reported that a lawsuit filed by J.R.R. Tolkien’s estate and publisher HarperCollins against New Line Cinema could impede production of "The Hobbit" films, and now another much anticipated film could become mired in legal limbo.

20th Century Fox filed a lawsuit against Warner Bros. over "Watchmen," the big-screen adaptation of the Alan Moore graphic novel currently in production. According to Fox, Warner Bros. does not own the rights to produce such a film, with Fox citing a complicated string of ownership conditions that the studio alledges were never secured by Warner Bros.

According to the Hollywood Reporter:

Fox seeks to enjoin Warners from going forward with the project, saying in the lawsuit that it seeks to "restrain (Warner Bros. Tolkien Estate, Publisher Sue New Line Over ‘Lord of the Rings’

Variety reports that publisher HarperCollins and the British charity that oversees the estate of Lord of the Rings author J.R.R. Tolkien have filed a lawsuit against New Line Cinema, the studio responsible for the "Lord of the Rings" film trilogy.

The suit was filed today in Los Angeles Superior Court and alledges that New Line Cinema neglected to provide either plaintiff with contractually obligated "gross profit participation" payment for the phenomenally successful films. The claim seeks $150 million from New Line, as well as a variety of other damages, including the right to terminate New Line’s license to the Tolkien properties.

If the studio loses the Tolkien license, it could end fans’ hopes for a Guillermo del Toro-helmed film based on The Hobbit, a widely speculated possibility.
